EwaZflorist terms and conditions
General
By placing any order on this Website or through phone or face to face you are agreeing to these terms and conditions.
Our normal working days for taking orders and consultations are Monday to Sunday and public holidays. For delivery and collections please go to Opening Hours & Delivery Information
Prices shown or agreed include VAT and exclude the cost of delivery.
Despatch of products will be arranged after we have received payment or notification of this.
Order acceptance and the completion of the contract between you and us will take place in the shop on the exchange of goods or on the despatch of the products ordered, if the order is placed through the Website or telephone.
All products will be at your risk from the time of delivery to you or your agent.
We take reasonable care to ensure that all details, descriptions and prices of products appearing on the Website or otherwise provided to you are correct at the time, but this information may not always reflect the position when you place an order on the Website or we order products for you.
In the event of supply difficulties, we reserve the right to substitute goods or packaging of similar quality and value.
We will treat all your personal information as confidential and keep it secure and use reasonable endeavours to comply with UK Data Protection and consumer legislation.
You will be given the option to receive information from EwaZflorist by post, e-mail or telephone, about products, promotions or special offers which we feel may be of interest to you. In the event that you do not wish to be contacted for such purposes, please communicate this to us, as you go through the ordering process.
These conditions shall be governed by and construed in accordance with the laws and courts of England.

Wedding & Events
Payment
A deposit is payable at the time your order is accepted and agreed. This is not refundable in any circumstances. Payment of the remaining balance is payable at least three weeks before the wedding or event date. If an order for a wedding or event is placed on a shorter note (less than three weeks before the event) all payments must be done at the same time as order accepted.
Access and Installation Arrangements
Where it is necessary for us to install flowers or other products you agree to arrange access for us to the premises at specific and agreed times. If for any reason we are unable to obtain access at the agreed times, we cannot guarantee the completion of the installation by the agreed times. We confirm that we will use out best endeavours to meet the time timetable. We cannot accept liability for any damages or costs due to us being unable to gain access to premises at the agreed times.
Photographs
You agree that any photographs of our flowers or products taken by us at your event or wedding may be displayed on our website or brochures. In the event that individuals are pictured we will seek your consent to display the pictures, which consent should not be unreasonably withheld.
Changes and Cancellation
We will accept changes to flowers and products ordered up to three weeks before the wedding. We cannot guarantee we can accept any changes after that time, but will use our best endeavours to accommodate such requests.
Payments made cannot be refunded if cancellation takes place less than three weeks before the date of the wedding or event. Shorter note orders payments made cannot be refunded.
Our liability for losses you suffer as a result of us breaching this agreement is limited to the purchase price of the product you purchased. We are not responsible for indirect losses which may occur as a consequence of the main loss or damage, including, but not limited to
1. Reduction of enjoyment of special occasions, such as weddings or special parties
b. Reduction in colour co-ordination or quality in pictures taken of events
We will not be liable or responsible for any failure to perform or delay in performance of any of our obligations that is caused by events outside our reasonable control.
Events outside our reasonable control include any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
1. Strikes, lock-outs or other industrial action.
b. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
c. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
d. Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
e. Impossibility of the use of public or private telecommunications networks.
f. The acts, decrees, legislation, regulations or restrictions of any government.
g. Unusual weather conditions
Our performance under any Contract is deemed to be suspended for the period that the event which is outside of our control continues, and we will have an extension of time for performance for the duration of that period.
Regular Supply Of Flowers And Other Products To Business And Other Individuals
Separate terms and conditions apply to the supply of flowers on a regular basis to businesses and other customers.
Corporate
Regular Supply Of Flowers Or Other Products
Where we have agreed to supply you with flowers or other products the following are the main terms of our supply agreement;
We will agree to supply and deliver flowers to you on a weekly or every two weeks (depending on the agreement) basis up to a minimum value per week, (including VAT).
The flowers will be delivered on a day to be agreed between us, unless this is a Bank Holiday, in which case they will be delivered on the next working day or a day to be agreed.
We will supply appropriate vases and /or containers. You agree to take reasonable care of the arrangements, vases and containers.
The content, and price if more than the minimum value, of the flower arrangements will be as discussed and agreed with one of your employees to be agreed, or appropriate representative, with details of any specific requirements to be communicated to us on or before one day before the normal delivery date before the relevant delivery. In the absence of specific requirements we will choose a varying range of seasonal flowers up to the minimum agreed value each week.
We will invoice you on a calendar month basis, for flowers delivered within that month and you agree to settle invoices within seven working days of the invoice date, by bank transfer or any other payment option chosen on the agreement day. We agree to report any damage to vases before they are removed from your premises and will invoice you for the replacement of the vase at its cost to us.
A representative of your will sign a delivery note in respect of each delivery of flowers, which will be retained by us.
We will endeavour to replace any damaged arrangements within a reasonable time and will invoice you for such a replacement arrangement.
We will use our best endeavours to ensure that all arrangements are prepared with fresh produce, but will undertake to replace any arrangements at no cost to you, should these arrangements materially deteriorate in appearance within five days of delivery, unless such deterioration is caused by you.
Rental Of Plants And Other Products
Where we have agreed to rent plants or other products to you the following are the main terms of our supply agreement;
You agree to hire from us plants and other products, which remain our property.
We will maintain the plants, checking and treating them weekly, or as appropriate, according to season.
We will provide replacement plants, of similar quality, at no additional charge to the customer, should they become unsuitable through natural causes.
You confirm that the plants and products are insured under their insurance arrangements against any damage, other than natural causes and agree that we will not have any responsibility to replace them in these circumstances. Causes of damage other than natural causes include disposal of liquids and other materials into the containers, bruising to the plant foliage by passers-by and exposure to excessive temperature changes.
We will be entitled to withdraw the plants and planters and terminate the agreement, if you do not pay invoices when due for payment.
You agree to pay an agreed monthly rental one month in advance.
Special Events
When we agree to provide flowers or other products to you for a special event, our terms and conditions for Weddings and Events will apply.
Cancellations
Regular supply two weeks cancellations note, otherwise will be still charged.
